SB 96 – Changes to California's Prevailing Wage Law Take Immediate Effect

Senate Bill 96 (SB 96) was enacted on June 27, 2017. Amongst other things, the bill makes changes to Labor Code sections 1725.5, 1771.1 and 1773.3 and Public Contract Code section 4104. Since SB 96 is an appropriations bill, the changes noted below take effect immediately.

California Supreme Court Allows More Taxpayers to Sue Local Government to Stop Wasteful Expenditures

The California Supreme Court recently issued a decision in the case of Weatherford v. City of San Rafael (June 5, 2017, S219567) ___ Cal.5th ___, clarifying who may sue certain local government entities, including cities and counties, to enjoin allegedly wasteful or illegal expenditures. Code of Civil Procedure section 526a allows "taxpayers" to file such actions. Prior cases had suggested that only taxpayers who had paid property taxes to the entity could file such an action. The Supreme Court rejected this narrow interpretation.

California Court of Appeal Rejects Challenge to Nuisance Ordinance

On May 1, 2017, California's First District Court of Appeals issued its opinion in Clary v. City of Crescent City. The Court rejected all of the plaintiff's numerous legal challenges to the City's nuisance ordinance, resolution to find a nuisance on his property, and proceedings to abate the nuisance.

California Court of Appeal Finds County Did Not Engage in "Piecemeal" Environmental Review

On April 25, 2017, California's Sixth District Court of Appeals issued its opinion in Aptos Council v. County of Santa Cruz, holding that the County did not violate California law when it separately considered the environmental impact of three ordinances in its effort to modernize zoning regulations.
